1. Data Controller

The data controller responsible for processing your personal data is:

EigerNest
Grindelwald, 3818
Canton of Bern, Switzerland
Email: [email protected]

This privacy policy is governed by the Swiss Federal Act on Data Protection (nDSG / revDSG), effective 1 September 2023.

2. Personal Data We Collect

We collect personal data only when you voluntarily provide it through our inquiry form or by contacting us directly. The data collected may include:

  • Full name
  • Email address
  • Phone number (optional)
  • Requested check-in and check-out dates
  • Number of guests
  • Message content and any additional information you choose to provide

We do not collect personal data through cookies, tracking pixels, or third-party analytics services that process personal data.

3. Purpose of Data Processing

We process your personal data solely for the following purposes:

  • Responding to your booking inquiry
  • Communicating with you regarding availability, pricing, and booking details
  • Managing your reservation and stay
  • Fulfilling legal obligations (e.g., Swiss registration requirements for accommodation providers)

The legal basis for processing is your consent (provided when you submit an inquiry), the performance of a contract or pre-contractual measures, and our legitimate interest in managing our rental property.

4. Website Analytics

We use Umami, a self-hosted, privacy-focused analytics platform, to understand general website usage. Umami:

  • Does not use cookies
  • Does not collect any personal data or personally identifiable information
  • Does not track visitors across websites
  • Collects only anonymised, aggregate data (page views, referrer, country, device type)
  • Is hosted on our own infrastructure in compliance with Swiss data protection law

Because Umami does not process personal data, no consent is required for its use under the nDSG.

5. Data Sharing

We do not sell, rent, or trade your personal data to any third parties. Your data may be shared only with:

  • Service providers who assist in managing our property (e.g., cleaning, maintenance), only to the extent necessary for the performance of their duties
  • Authorities, where required by Swiss law (e.g., guest registration with the municipality)

We do not transfer personal data to countries outside of Switzerland or the EEA unless adequate data protection is ensured.

6. Data Retention

Inquiry data is retained for the duration of the business relationship and for a period of 10 years thereafter, in accordance with Swiss commercial and tax record-keeping obligations (Swiss Code of Obligations, Art. 958f). After this period, data is securely deleted.

If your inquiry does not result in a booking, your data will be deleted within 12 months unless you request earlier deletion.

7. Data Security

We implement appropriate technical and organisational measures to protect your personal data against unauthorised access, alteration, disclosure, or destruction. These measures include encrypted data transmission (TLS/SSL), secure hosting, and restricted access to personal data.

8. Your Rights

Under the Swiss nDSG, you have the following rights regarding your personal data:

  • Right of access: You may request information about whether we process your personal data and, if so, what data we hold.
  • Right to rectification: You may request correction of inaccurate or incomplete personal data.
  • Right to deletion: You may request deletion of your personal data, subject to legal retention obligations.
  • Right to data portability: You may request your data in a commonly used electronic format.
  • Right to object: You may object to the processing of your data at any time.

To exercise any of these rights, please contact us at [email protected]. We will respond to your request within 30 days.

9. Changes to This Policy

We may update this privacy policy from time to time to reflect changes in our practices or legal requirements. The updated policy will be published on this page with a revised date. We encourage you to review this page periodically.
